How Is the Defense Base Act (DBA) Responding to COVID-19?

Jun 2, 2022 | Defense Base Act

The Defense Base Act has been providing injury and evacuation benefits for overseas military workers since it was created in 1941.

However, the COVID-19 pandemic saw a sharp increase in the number of DBA claims being made by overseas contractors who ended up catching the virus.

Unfortunately, there have been few clear guidelines regarding what kind of compensation federal contractors are entitled to if they come down with COVID-19. But we can offer guidance regarding Defense Base Act claims and what you can do to make sure you’re getting everything you deserve.  Read on to find out more.

Does the Defense Base Act Cover Illness?

Usually, the Defense Base Act only offers compensation for injury or evacuations. However, given the severity of the pandemic, it seems many DBA coverage packages are offering support for those suffering from COVID-19 overseas

If you feel you are experiencing symptoms of COVID-19, you will be able to get tested by your medic. You should do this as soon as possible, both for your own health and to reduce the spread of the virus.

Getting diagnosed earlier will also help to start the process of acquiring any DBA compensation faster. This will offer you financial peace of mind whilst you recover.

What About Evacuations Related to Covid-19?

Evacuations are complicated in general, and the pandemic has not made them any easier to deal with. Due to travel restrictions, those providing routes for evacuation must comply with government guidelines. This may mean you find yourself unable to evacuate if you contract COVID-19.

However, there have been cases in which specific biocontainment units have been used for COVID-19 evacuations. This is generally left up to the employer and the insurer, who will decide amongst themselves if evacuation is the right call.

Regardless, government procedures must be followed. If evacuating poses a greater contamination risk than not evacuating, it is likely remaining in the host country will be considered the safer option.
